SALES CONDITIONS

1. Object

These conditions of sale (hereinafter, the "Conditions of Sale" or the "Conditions") establish the terms that regulate the purchase by the user ("User" or "Customer") of any of the products offered by the Seller (the "Products") through the CUPRA Marketplace (the "Website").

If you have any questions regarding these Conditions of Sale, or the Products, you can contact the Seller through the means of contact indicated above.

2. Product Information

The information relating to the Products will be published and accessible to the Customer on the Website, (Store tab). The prices of the Products include applicable taxes and will be indicated on the Web.

2.1. Shipping fees apply per order. The exact price of the shipping fee is as follows:

  • Zone 1 – Portugal 4,60€
  • Zone 2 – Austria, Belgium, Denmark, France, Germany, Ireland, Italy, Luxembourg, Monaco, United Kingdom 18,53€
  • Zone 3 – Bulgaria, Croatia, Slovakia, Slovenia, Estonia, Finland, Greece, Hungary, Latvia, Lithuania, Poland, Czech Republic, Romania, Sweden 20,31 €
  • Zone 4 – Liechtenstein, Norway, San Marino, Switzerland 21,71 €

2.2. The total price specified in the final checkout menu includes taxes and shipping costs. Prices are quoted upon order confirmation, which you can print or download for future use. Please only pay the exact amount specified in your order confirmation and make individual payments per order.

3. Delivery conditions

The Products offered through the Website are available for shipment. Once the purchase has been formalized by the User through the Web, the Seller will proceed to send the Product, according to these Conditions.

3.1    We deliver products from Monday to Friday from 9am to 5pm. We do not ship on certain holidays.

To receive the order, you must ensure that someone is at the address. This service does not include scheduling or booking options, meaning delivery of the order will be made without prior contact from the carrier. We do not guarantee this period during periods of promotions, sales, Christmas and out of stock. Delivery is considered made or a product is considered delivered with the signature of the delivery receipt at the agreed address.

3.2    Delivery Times - If you confirm your order on a business day before 12pm and pay by Credit Card or via Paypal, your order will be sent on the next business day (weekends and holidays are not considered business days). If you choose to pay by ATM reference, shipping is less efficient, as we will only ship after we receive payment. This may take between 3 to 5 days.

Tetribérica will not be responsible for non-compliance, or delay in compliance, with any obligation that is due to a force majeure event, that is, an event, act or omission, beyond its reasonable control (Force Majeure Event - which includes any event, act or omission, beyond the reasonable control of the "Seller").

We will attempt to deliver on time to an extent commercially reasonable. As a rule, we always proceed in this way, however, we cannot guarantee timely delivery.

3.3 Partial Deliveries - Whenever possible we will try to deliver everything in just one shipment. However, we reserve the right to split delivery of the order, for example (but not limited to) if one part of the order is delayed or unavailable. If we divide the order, the customer will be notified, by email, of our intention to proceed in this way. For this purpose, the email address provided by the customer at the time of purchase will be used.

3.4 Inspection upon delivery - Upon delivery, the customer must inspect the packaging to check for any damage. If the products are found to be damaged, the customer must not accept delivery of the order which will be returned. Tetribérica will reimburse the amounts paid for the order and transportation, as soon as the warehouse receives and completes the return process. Any complaint about non-receipt of an order must be made within a maximum period of 30 days from the date of placing the order. After this period, Tetribérica cannot be held responsible for the loss of the item.

4. Right of withdrawal of the Customer on the Products

The Customer, when acting as a consumer, will have the right of withdrawal on the purchase made through the Web, without the need to indicate the reason and without incurring any cost, during the period of fourteen (14) calendar days from the day of delivery of the Product.

The Customer shall only be liable for the decrease in value of the goods resulting from handling that goes beyond what is necessary to establish the nature, characteristics and functioning of the Products.

The Client may use the withdrawal form included as Annex I, although its use is not mandatory. The Customer must send his communication of the right of withdrawal through the means of contact indicated above.

To comply with the withdrawal period, it is sufficient that communication regarding the exercise by the Client of this right is sent before the corresponding period expires.

In case of withdrawal by the Customer, the Seller will proceed to refund all payments received from it, without any undue delay and, in any case, no later than fourteen (14) calendar days from the date on which it is informed of the Customer's decision to withdraw from this contractual relationship.

The Seller will proceed to make such reimbursement using the same means of payment used by the Customer for the purchase, unless the Customer has provided otherwise, and this is technically possible. In any case, the Customer will not incur any expenses because of the refund (with the exception of additional expenses resulting from his choice of a delivery method other than the least expensive mode of ordinary delivery offered by the Seller).

5. Returns

Without prejudice to the rights of the Customer established in clause 4 above, the Seller offers the following return policy:

5.1 Cancellation of the order before shipping

The customer can cancel the order, if it has not yet been shipped. If the customer places an order and wants to cancel it, they must first check the status of the order through in My Order menu located in the top right corner of the website's main page. And if the order status says “Registered” there is a possibility that it will still be cancelled. However, the customer must contact our Customer Service and request the cancellation of their order. Only after this procedure is it possible for our Customer Service Department to request our warehouse to cancel the order.

If the cancellation request is successful, the customer will be notified by email of this decision, and the cancellation will be processed at no cost to the customer. If the cancellation request is not possible, the products will be sent to the customer who, if he maintains his intention to cancel the order, must refuse to receive them. The products will be returned, and, upon receipt, the refund will be processed.

Orders for personalized products cannot be canceled before shipping, as the personalization process is already underway, as it starts immediately after receiving the order. However, the customer can make a return according to the conditions and return rules mentioned below.

5.2 Return of defective products

The customer has the right to return the delivered products if they are found to have defects or other non-conformities in relation to the products ordered. Returns can be made within 30 days of receiving the order. This does not affect your statutory rights. If your complaint is justified, the price and shipping costs will be refunded. For more information on how to make a return and information on refunds, please consult the Help/FAQ's menu on the website.

5.3 Return of products due to withdrawal - If for any reason you are not satisfied with the products you ordered, you can return them within 30 calendar days after receipt, provided that:

  • The product maintains its original characteristics and the packaging is not damaged (carefully open packaging will not be considered damaged);
  • The product is complete (e.g. both items in a pair must be returned);

5.4 Return information

If your return is justified by the existence of a defect or non-conformity with the products ordered, SELLER will bear the shipping and return costs. If your return was made for reasons other than the justified existence of a defect or non-conformity of the products ordered, SELLER will not reimburse the shipping costs. However, when making a return you will be using our transport provider. As the costs incurred by SELLER to make the return are equal to the shipping costs, Tetribérica will not reimburse the costs related to postage initially borne by the customer for the respective order.

Refunds will be made based on the payment method. If the customer makes the payment by ATM reference, the customer must provide their bank details to our Customer Support when starting the return process. This indication is necessary so that we can refund the money to your account. The customer will receive a refund after the product(s) has been returned and processed.

For additional information about the return process and refund times, please see the Help/FAQ's section of the website. Please read the instructions in that section and follow the instructions carefully to avoid unnecessary delays.

Fulfillment of all orders placed on the website is subject to availability. SELLER tries to ensure that all items offered for sale on the website are in stock. However, SELLER reserves the right not to accept any orders or cancel orders already confirmed for products that are no longer in stock. In these cases, SELLER will inform the customer of this fact and refund the amount paid.

6. Product Warranty

Without prejudice to the provisions of clauses 4 and 5 above, the Seller will respond to the Customer in the event that the Products present any lack of conformity, that is, that they do not conform to the description and qualities made available to the Customer on the Web, are not suitable for the ordinary uses for which they are intended or have manufacturing defects.

The legal warranty period for the Products is [three (3) years] from the date of delivery of the Product to the Customer (the "Warranty"), but does not include deficiencies caused by negligence, misuse or improper handling of the Product by the Customer.

Once the existence of such defects or lack of conformity has been verified by the Seller, and if they are covered by the Warranty, the Customer may choose between repair or replacement of the Product, unless one of these two options is impossible or, compared to the other, involves disproportionate costs for the Seller. All this in accordance with the provisions of the applicable regulations on consumers and users. To benefit from the Warranty, the Customer must keep his purchase confirmation.

7. Applicable law, competent courts

These Conditions of Sale are governed by the Portuguese legislation. To the extent that the Customer is a consumer, these Conditions will also be subject to any applicable local laws. Any dispute that may arise as a result of these Conditions of Sale will be submitted to the competent courts of Tribunal Arbitral do Consumo de Portugal, and in the case of a customer acting as a consumer, to the court of the domicile corresponding to the Customer.

Customers acting in their capacity as consumers may also submit any dispute arising out of or related to these Terms to an Alternative Dispute Resolution procedure ("ADR"), if applicable. Notwithstanding the foregoing, the Seller does not undertake or is obliged to take part in online dispute resolution proceedings before the consumer arbitration body.

8. Information on website

Although SELLER works on its website with great care, the information, texts, graphic documents, films, music and/or other services may contain errors or be incomplete or incorrect. SELLER cannot be held responsible for any damages resulting from the use (or inability to use) the website, including damages caused by viruses or any inaccuracy or imperfection of information, unless such damage is the result of willful misconduct or negligence on the part of SELLER.

9. Privacy

The personal data collected with the order shipment will be processed solely for the purpose of fulfilling the Customer’s explicit requests, in accordance with further processing will only be carried out with the express consent of the Customer.

10. DSA Certificate

The seller agrees to offer exclusively products that comply with the applicable provisions of EU law.
