1. Purpose
These general terms and conditions of sale (hereinafter, the "Terms of Sale" or the "Terms") establish the terms that regulate the purchase by the user ("User" or "Customer") of any of the products offered by the Seller (the "Products") through the CUPRA Marketplace (the "Website").
If you have any questions related to these Terms of Sale or the Products, you may contact the Seller through the contact means indicated on the Website.
2. Product Information and Prices
Information related to the Products will be published and accessible to the Customer on the Website.
Product prices include applicable taxes and will be indicated on the Website.
Once the purchase is formalized by the User through the Website, the Seller will proceed to send the Product, according to these Terms.
3. Shipping
Free shipping on orders over €50.00. For orders under €50.00, shipping costs are €5.
Delivery times:
- Spain (Peninsula) and Balearic Islands: 1-3 business days.
- Rest of the world: 1-5 business days
4. Returns
The Customer, when acting as a consumer, will have the right to withdraw from the purchase made through the Website, without needing to indicate any reason and without incurring any cost, within fifteen (15) calendar days from the day of delivery of the Product.
The Customer will only be responsible for the decrease in the value of the goods resulting from handling that goes beyond what is necessary to establish the nature, characteristics, and functioning of the Products.
The Customer may use the withdrawal form included as Annex I, although its use is not mandatory. The Customer must send their communication of the right of withdrawal through the contact means indicated, via the Website, in the Seller's section.
To meet the withdrawal deadline, it is sufficient that the communication concerning the exercise of this right by the Customer is sent before the corresponding deadline expires.
In the event of withdrawal by the Customer, the Seller will proceed to refund all payments received from the same, without undue delay and, in any case, no later than fourteen (14) calendar days from the date on which the Seller is informed of the Customer's decision to withdraw from this contractual relationship.
The Seller will carry out said refund using the same means of payment used by the Customer for the purchase, unless the Customer has provided otherwise, and it is technically possible. In any case, the Customer will not incur any expenses as a result of the refund (except for the additional costs resulting from the choice by the Customer of a delivery method different from the least expensive ordinary delivery method offered).

5. PRICES
The prices shown on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment charges are in any case communicated in advance to the Customer through the site or these Conditions.
6. Order Cancellation Process
You will not be able to process the cancellation of your order once it has been processed.

7. Product Warranty
Without prejudice to the provisions of clauses 4 and 5 above, the Seller will be liable to the Customer in the event that the Products show any lack of conformity, that is, they do not correspond to the description and qualities made available to the Customer on the Website, are not suitable for the ordinary uses to which they are intended, or have manufacturing defects.
The legal warranty period for the Products is three (3) years from the date of delivery of the Product to the Customer (the "Warranty"), although deficiencies caused by negligence, incorrect use, or improper handling of the Product by the Customer are not included.
Once the Seller has verified the existence of such defects or lack of conformity, and provided they are covered by the Warranty, the Customer may choose between the repair or replacement of the Product, unless one of these two options is impossible or, in comparison with the other, involves disproportionate costs for the Seller; all in accordance with the provisions of the applicable regulations on consumer and user matters.
To benefit from the Warranty, the Customer must retain their purchase confirmation.

9. Legislation
These Terms of Sale are governed by Spanish law. To the extent that the Customer is considered a consumer, these Terms will also be subject to any applicable local legislation.
Any dispute that may arise from these Terms of Sale will be submitted to the competent courts of Spain, and in the case of a Customer acting as a consumer, to the court corresponding to the consumer's domicile.
Customers acting as consumers may also submit any conflict arising from or related to these Terms to an Alternative Dispute Resolution procedure (hereinafter, "ADR"), if applicable. Without prejudice to the above, the Seller does not commit to and is not obliged to participate in online dispute resolution processes before the consumer arbitration body.
10. Privacy
The personal data collected with the order will be processed by the Seller solely to address the Customer's express requests, in accordance with Regulation EU 2016/679 and the site’s privacy policy. Any subsequent processing will be carried out only with the express consent of the Customer.
