1. CONDITIONS OF SALE
 
These general terms and conditions of sale ("Terms of Sale") set out the terms governing the purchase by the user ("User" or "Customer") of the products offered by the Seller through the CUPRA Marketplace (the "Website"). 
If you have any questions regarding these Terms of Sale or the Products, you may contact the seller through the contact methods indicated on the Website. 


2. PRODUCTS: INFORMATION AND PRICES
 
The information relating to the Products will be published and accessible to the Client on the Website. This Website will only be used to sell products and shipments to Spain, Andorra and intra-EU countries of the European Community.  The items purchased by the Customer will be processed within 24/48 hours of the acceptance of the Order by CAFÉ DE FINCA, at the cost specifically indicated in the Store before the shipment of the Order. 
The price of the products on the Website includes Value Added Tax (VAT) and will be understood in euros (€). Product prices may vary and include offers and promotions. Shipping costs will be detailed separately on the invoice. The price also includes transport and packaging costs. The customer will assume a lump sum for the shipment which may vary according to the weight and value of the order and the place to which it must be sent, with consideration of a possible surcharge for delivery in a remote area. 
Before confirming the purchase, the customer will be shown the total cost of the order, and he will have the possibility of modifying -totally or partially- or completely canceling the order. 
Prices may change at any time. However, any changes will not affect Products in respect of which CAFÉ DE FINCAS SL has already sent the Dispatch Confirmation. 


3. DELIVERY TIMES AND CONDITIONS
 
Once the purchase has been formalised by the User through the Website, the Seller will proceed to send the Product,in accordance with these conditions. The delivery times indicated must be considered purely indicative and a delay or possible delivery made with successive split shipments does not entitle the Customer to refuse the delivery itself and to request compensation or compensation. In addition, in periods of high demand or holidays, these times may be longer than usual. 

4. SHIPPING 
Free shipping is made in the following shipping areas from €35 of coffee order: Portugal, France, Italy, Germany, Denmark, Belgium, Luxembourg, Netherlands.
In all other countries, or order amounts, shipping costs are governed by the final weight of the product, total value and geographical area. You can consult the shipping cost tables in point 4.2. 

Delivery times and type of delivery: 
   - Between 48-72h to Portugal – GLS Express 
   - Between 5-10 days Canary Islands, Andorra, rest of Europe. – GLS

5. RETURNS
 

The Client, when acting as a consumer, will have the right of withdrawal on the purchase made through the Website. To execute this withdrawal, it is necessary to indicate the product that is returned and the reason, within a period of fourteen (14) calendar days from the day of delivery of the Product. 
The Client will be responsible for the decrease in value of the goods resulting from handling that goes beyond what is necessary: operation and maintenance of the product. 
The Client must send their communication of the right of withdrawal through the means of contact indicated, through the Website, in the Seller's section (more information in FAQs: returns and guarantees section). 
In order tocomply with the withdrawal period, it is sufficient that the communication regarding the Client's exercise of this right is sent before the expiry of the corresponding period. 
In the event of withdrawal by the Client, the Seller will proceed to refund all payments received from the Client, without any undue delay and, in any case, no later than thirty (30) calendar days from the date on which it is informed of the Client's decision to withdraw from this contractual relationship,  subject to the effective receipt of the product by the Seller and once it has been verified that the product is returned in correct condition. 
The Seller will proceed to make such a refund using the same means of payment used by the Customer for the purchase, unless the Customer has arranged otherwise, and this is technically possible. The shipping costs related to the return of the product will be borne by the customer and will be deducted from the total refund (warranty and quality of the products). 
The seller reserves the right to withhold the refund until it has received the goods and the condition of the goods. The refund will be made within 30 days, after the completion of the process. 

5.1Exceptions to the right of withdrawal: The right of withdrawal will not be applicable to contracts that refer to: 
5.1.1The supply of goods that may deteriorate or expire quickly. As well as perishable products such as coffee, ground coffee and substitutes.  
5.1.2The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery. 


6. ORDER CANCELLATION PROCESS
 
You can process the cancellation of your order as long as it has not been processed. In other words, even if the payment has been made, the order has not left our facilities, or in the case of a custom order, it has not gone to the production line. 
To process your cancellation, please send us an email to info@cafedefinca.es with your personal details and the identification details of the order (order number) if you have any questions. 


7. PRODUCT WARRANTY
 
7.1Warranty: All CAFÉ DE FINCA products offered through the website are completely original, unless otherwise stated in their description. 
7.2 Satisfaction guarantee: If at the time of receiving the product and, before exercising the right of withdrawal, the user is not satisfied with the purchase, he or she may choose to exchange the product for a voucher of the same value as the product purchased and returned, to exchange it for another of the same value (if the price of the product is higher than the price of the voucher,  the user must pay the difference) Shipping, delivery or return costs are not included in this voucher. 
7.3Warranty in case of defective product: In the event of a defective product, CAFÉ DE FINCA must proceed with the repair, replacement, price reduction or termination of the contract (as appropriate), procedures that will be free of charge for the user. CAFÉ DE FINCA is liable for any lack of conformity that manifests itself within three years of delivery; the consumer-user must inform CAFÉ DE FINCA of the lack of conformity within two months of becoming aware of it.

8.2.Response Deadlines: We undertake to respond to all queries within a maximum period of 72 working hours from the receipt of these. 


9. LEGISLATION
 
The contract of sale referred to in these conditions is regulated by Italian law, without taking into account the rules of conflict and the United Nations Convention for the International Sale of Goods. The Court of the Client's municipality of residence shall have jurisdiction for the settlement of related disputes. 


10. PRIVACY
 
The personal data collected with the shipment of the order will be processed by CAFÉ DE FINCAS SL for the sole purpose of attending to the express requests of the Client, in accordance with EU Regulation 2016/679 and the privacy policy of the site. Any further processing will be carried out only with the express consent of the Client.
