1. CONDITIONS OF SALE

These general conditions of sale (“Conditions of Sale”) establish the terms and conditions regulating the purchase by the user (“User” or “Customer”) of the products offered by the Seller via the CUPRA Marketplace (the “Web Page”).

2. PRODUCTS: INFORMATION AND PRICES

Information about the Products will be published and accessible to the Customer on the Web Page. On this Web Page, products will only be sold and shipped to Mainland Spain and the Balearic Isles. No deliveries to the Canary Isles, Ceuta and Melilla. The articles purchased by the Customer will be processed within the 24 hours following acceptance of the Order by AUDES, at the cost specifically indicated in the Store prior to sending the Order.

The price of the products on the Web Page includes Value Added Tax (VAT) and will be given in euros (€). The prices of the products may vary and include special offers and deals. Shipping costs will be itemised separately in the invoice. The price also includes the shipping and packing costs. The customer will accept a global sum for the shipment which may vary depending on the value of the order and the location to which it is to be sent, with the possibility of surcharges for delivery to remote zones.

Prior to confirming the purchase, the customer will be shown the total cost of the order with the option to modify, in full or in part, or to completely cancel the order.

Prices may change at any moment. Nevertheless, any possible changes will not affect Products for which AUDES has already sent the Confirmation of Shipment.

3. TIMES AND CONDITIONS OF SHIPMENT

Once the purchase has been formalised by the User via the Web, the Seller will send the Product, in accordance with these conditions. The delivery times indicated are intended for guidance only. A delay or the delivery made in successive shipments will not entitle the Customer to reject the delivery or request compensation or indemnity. In addition, in periods of high demand or holidays, it is possible that the delivery times are longer than usual.

4. SHIPPING

Free delivery for orders over €100.00. For orders less than €100.00, the shipping costs are €6.50 (except Romania, Slovenia, Austria, Denmark, Finland, and Sweden which are €8.00, Slovakia, Greece, Hungary, Malta, Estonia, Croacia which are €9.00 and Netherlands and Poland which are €15.12).

Delivery times: 48-72 hours.

No deliveries to United Kingdom, Norway, Switzerland, Germany and Austria.

5. RETURNS

The Customer, when acting as the consumer, has the right to withdraw from the purchase made via the Web Page. To exercise this right of withdrawal, it is necessary to indicate the product being returned and the reason, within thirty (30) calendar daysfrom the Product delivery date.

The Customer will be responsible for any reduction in the value of goods resulting from any handling beyond necessary: operation and maintenance of the product.

The Customer should submit their notification of the right to withdraw using the methods of contact indicated, via the Web Page, in the Seller's section (further information in FAQs: section on returns and guarantees).

To comply with the withdrawal deadline, the notification regarding the exercise of this right by the Customer should be sent prior to the expiry of the corresponding right.

In the event of withdrawal by the Customer, the Seller shall proceed to refund all the payments received from the Customer, without undue delay and, in any case, no later than thirty (30) calendar days from the date on which they were informed of the Customer's decision to withdraw from the present contract, subject to the effective receipt of the product by the Seller and after confirming that the product has been returned in the correct condition.

The Seller will make the refund using the same means of payment used by the Customer for the purchase, unless the Customer has requested otherwise and this is technically possible. The shipping costs for the return of the product will be borne by the customer and where applicable, deducted from the total amount refunded (guarantee and quality of the products).

The seller reserves the right to retain the repayment until they have received the goods and confirmed their condition. The refund must be made within 30 days, after completion of the process.

6. ORDER CANCELLATION PROCESS

You can cancel your order as long as it has not already been processed. That is, even if the payment has been made, the order has not left our facilities, or in the event of a personalised order, it has not been sent to the production line.

7. PRODUCT WARRANTY

All articles sold by AUDES are covered by the twelve (12) month warranty for non-compliance, pursuant to Title III of Legislative Decree n. 206/2005. To make use of the warranty, the customer must keep the invoice, or receipt of payment, together with the shipping document.

The warranty for non-compliance will always be applied to the corresponding article provided it has been used correctly, for its intended purpose and in accordance with the instructions for use and washing given on and/or with the article.

If, for any reason, AUDES cannot provide the Customer an article under warranty (restored or replaced), or if the repair or replacement are, given the value of the article, excessively costly, AUDES may proceed with the relevant reduction of the price paid, that is, the reimbursement of the total amount paid with the termination of the contract.

In those cases in which the application of the warranties envisages the return of the article, this must be returned by the customer in its original packing, all parts intact (including the packaging and any documentation or accessories).

9. LEGISLATION

The sales contract to which these conditions refer is regulated by Italian law, without considering the rules of conflict and the United Nations Convention for the International Sale of Goods. The Courts in the Customer's place of residence shall have jurisdiction for the settlement of any disputes.

10.PRIVACY

Personal data collected when placing the order will be processed by AUDES with the sole purpose of responding to the explicit requests of the Customer, pursuant to Regulation EU 2016/679 and the privacy policy of the site. Any subsequent processing will only be carried out with the express consent of the Customer.
